Welcome to www.velorahealthconnect.com.au ("Site"). This Site is owned and operated by Velora Edge Group Pty Ltd ABN 24 693 639 879 trading as Velora HealthConnect. Please take the time to read the terms of use that are applicable to your use and enjoyment of this Site and the content made available to you via this Site and our social media channels ("Terms"). These Terms together with our Privacy Policy apply to all Site visitors, subscribers, customers, and all other users of the Site ("user", "you" and "your").

Consent to Site Terms

By accessing and using this Site, our social media channels and any other materials made available to you or provided to you on this Site, whether made available for purchase or not, you are taken to accept our Terms.

No Minors

By using the Site, accessing or purchasing any products or services, you warrant that:

  • You are over 18 years of age and have the legal capacity to enter into a legally binding contract;
  • Have read and accepted these Terms; and
  • Will comply with these Terms.

Applicable Law & Regulation

Our Clinic complies with all applicable laws and regulations relating to the provision, promotion and advertising of health services, including but not limited to:

  • Therapeutic goods laws
  • Consumer law obligations
  • Health service advertising restrictions
  • Clinical governance obligations

Specific legal obligations may apply to different services offered, including additional requirements in certain states.

Description of Services

Clinical Consultation & Communication Services

We enable communication, consultations and clinical interactions (where appropriate) between you and:

  • AHPRA-registered health practitioners, including General Practitioners and Nurse Practitioners, who may assess, diagnose, prescribe medications and request pathology or diagnostic investigations where clinically indicated;
  • Healthcare support professionals engaged by Velora HealthConnect, which may include pharmacists, nurses, dietitians, nutritionists, health coaches, fitness professionals and patient support staff;
  • Independent third-party healthcare providers and pharmacies who partner with Velora HealthConnect but operate independently and are not employed or controlled by us.

All prescribing decisions, referrals and clinical recommendations are made solely at the discretion of the treating practitioner.

Digital Platform Access

Velora HealthConnect provides access to secure online platforms that may include:

  • Records of your consultations and communications with healthcare professionals;
  • Clinical documentation and, where applicable, pathology or diagnostic results;
  • Educational materials and support tools relevant to your health condition;
  • Lifestyle guidance resources such as nutrition guidance, exercise information and general wellness content;
  • Tracking tools and insights designed to support informed health decisions.

Access to these tools is intended to support your care but does not replace personalised medical advice.

Prescription Fulfilment & Pharmacy Coordination

Where a practitioner issues a prescription:

  • We may facilitate the transmission of that prescription to a participating independent pharmacy;
  • You may choose to have prescriptions dispensed by one of our partner pharmacies or by a pharmacy of your choice;
  • Velora HealthConnect does not manufacture or dispense prescription medications unless explicitly stated.

All dispensing decisions are made by the pharmacy in accordance with applicable laws and professional standards.

Medication & Product Delivery

Where medications or approved products are supplied:

  • Delivery may be arranged through independent courier or postal service providers;
  • Shipping timeframes and handling are subject to the policies of the relevant pharmacy and courier;
  • Velora HealthConnect is not responsible for delays caused by third-party logistics providers outside our control.

Other Products & Services

Through our platforms, we may offer additional health-related products or services, including items produced for or on behalf of Velora HealthConnect. Where applicable, we may coordinate delivery via third-party providers.

Changes to These Terms

We reserve the right to change or modify these Terms at any time consistent with applicable laws and principles, without notice to you. These changes will be effective as of the date we post the revised version on this Site. It is your responsibility to review these Terms prior to use and periodically throughout your use of our Site and services. If at any time you choose not to accept these Terms, you should not use this Site.

By remaining on this Site and your continued use of this Site is deemed acceptance of any modifications or amendment of these Terms. You may also accept these terms where you click "Agree" or "Accept" or "Buy" or "Book" where such an option is made available to you during your use of the Site.

Use of Artificial Intelligence (AI)

Our Clinic may use secure third-party AI-powered software to assist in administrative tasks such as:

  • Clinical note-taking
  • Appointment summaries
  • Transcription of consultations

AI tools are used to improve efficiency and service quality. All data is managed in accordance with our Privacy Policy and appropriate data security standards apply. No AI software is used for diagnosis or treatment decisions.

Bookings and Consultations

All bookings made through our Site or affiliated platforms are subject to our Booking Policy, which forms part of these Terms.

  • Consultations must be booked via our Site or designated platforms;
  • Fees for consultations are payable at time of booking;
  • You may be asked to complete intake forms and health history before treatment;
  • We reserve the right to decline or refer treatment if we deem it unsafe or inappropriate.

Appointment Reminders

You will receive a reminder before your scheduled appointment. Please ensure your contact details are up to date.

No Show or Late Arrivals

Your appointment time is reserved exclusively for you. If you fail to attend without notice or arrive too late for your appointment to be safely or effectively delivered:

  • Your consultation fee will be forfeited;
  • Repeat no-shows may result in restrictions on future bookings.

We reserve the right to decline further bookings from clients who repeatedly miss or arrive late for appointments as this disrupts care for other clients and impacts clinic efficiency.

Please note that arriving more than 10 minutes late may be treated as a missed appointment.

Cancelling, Rescheduling & Refunds

Exceptions

We understand that illness, emergencies or other unforeseen events may occur. We will review cancellation requests on a case-by-case basis.

How to Cancel

To cancel an appointment:

Cancellations are valid once you receive written confirmation from us.

Refunds

  • Cancellations made within the required notice period may be eligible for a full or partial refund, minus applicable fees;
  • No refunds will be issued for cancellations outside this timeframe, except as required under Australian Consumer Law;
  • If we cancel your appointment, a full refund will be provided.

Rescheduling

You may reschedule your appointment once without additional fees, if at least 48 hours notice is provided. Rescheduled appointments must occur within 3 weeks of the original booking date. Requests outside this timeframe may be treated as cancellations. Exceptional cases will be considered on an individual basis.

Subscription Payments

Subscription Model

By commencing a subscription, you enter into a recurring agreement under which:

  • You agree to pay the applicable subscription fee at the nominated billing interval (typically monthly); and
  • Velora HealthConnect agrees to make the relevant Services available to you during that period.

The applicable pricing, billing frequency and key subscription terms will be presented to you during checkout and confirmed at the time of purchase.

Automatic Renewals

Subscriptions automatically renew at the end of each billing cycle unless cancelled beforehand. By maintaining an active subscription, you authorise us to charge your nominated payment method at each renewal date for the applicable subscription fee. We will provide advance notice prior to renewal and offer you the opportunity to pause or cancel your subscription before the next billing cycle begins.

Changes to Fees or Terms

We may vary subscription fees or payment terms from time to time. Where changes are made:

  • Updated pricing or terms will be published on the Platforms or otherwise notified to you; and
  • The changes will apply to renewal periods occurring after the effective date of the variation.

You will be given the opportunity to cancel your subscription prior to the updated terms taking effect.

Pricing

Unless otherwise stated:

  • All prices displayed on the Platforms are in Australian Dollars;
  • Prices are inclusive of GST where applicable; and
  • Shipping costs, where relevant, are included or clearly disclosed at checkout.

Subscription Cancellations

Cancellation by You

You may cancel your subscription at any time. Cancellations can be completed by:

  • Logging into your account via the Platform and following the subscription management prompts; or
  • Contacting our support team at [email protected].

Cancellation will prevent future billing cycles from being processed. You will retain access to Services for the remainder of any billing period already paid for, unless otherwise stated.

Cancellation by Velora HealthConnect

We reserve the right to suspend or cancel a subscription at our discretion, including where:

  • There has been a breach of these Terms;
  • Payment has failed; or
  • Continued provision of Services is not clinically appropriate or operationally feasible.

Effect of Cancellation

Once a subscription is cancelled:

  • No further subscription fees will be charged; and
  • No future orders or Services will be provided under that subscription.

Payment Plans

We may offer eligible clients the option to pay for certain services via an approved payment plan. You acknowledge and agree that:

  • Payment plans are subject to approval and may not be available for all services;
  • You must comply with the agreed payment schedule, including all instalment dates and amounts;
  • Failure to meet scheduled payments may result in suspension or cancellation of services, and any outstanding balance will remain payable;
  • Payment plans may be facilitated through a third-party provider (e.g. Afterpay, Zip, or similar), in which case the terms and conditions of that provider will also apply;
  • We reserve the right to withdraw or amend payment plan options at any time without prior notice;
  • Late or missed payments may incur additional fees or interest as outlined in the payment plan agreement;
  • Entry into a payment plan does not affect your rights under Australian Consumer Law.

Prices and Payment

Prices

We will endeavour to ensure the prices listed on our Site are accurate and current. However, where pricing errors occur, we reserve the right to correct them without liability to you. If you have already purchased a product or service at an incorrect price, we will notify you and offer you the option to proceed at the correct price or receive a full refund.

All prices are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Delivery fees, where applicable, will be disclosed at checkout.

Discounts

Discount codes and promotional offers are subject to specific terms and conditions as stated at the time of the offer. Unless otherwise stated:

  • Discounts cannot be combined with other offers;
  • Discounts are not transferable or redeemable for cash;
  • We reserve the right to withdraw or modify any discount or promotional offer at any time.

Credit Card Authorisation

By providing your credit card or payment details, you authorise us (or our third-party payment processor) to charge your nominated payment method for any products, services or subscriptions you purchase through the Site. You warrant that you are an authorised user of the payment method used.

All payment transactions are processed through secure, PCI DSS-compliant third-party payment gateways. We do not store your full credit card details on our systems.

Products and Allergies

Some products available through our Site, including skincare products, supplements and topical treatments, may contain ingredients that could cause an allergic reaction or adverse effect. It is your responsibility to:

  • Review all product ingredients and labels before use;
  • Inform your treating practitioner of any known allergies, sensitivities or medical conditions;
  • Conduct a patch test where recommended before using a new product;
  • Discontinue use immediately and seek medical advice if you experience any adverse reaction.

Velora HealthConnect does not accept liability for allergic reactions, adverse effects or any other harm resulting from your use of products where you have failed to disclose relevant health information or have not followed product usage instructions. Nothing in this clause excludes or limits any rights you may have under Australian Consumer Law.

Related Products and Services

Certain products or services available through our Site may be subject to regulatory restrictions, including but not limited to prescription medications, therapeutic goods and controlled substances. These products and services:

  • May only be provided following a clinical assessment by an AHPRA-registered practitioner;
  • Are subject to the practitioner's clinical judgement and prescribing authority;
  • May not be available in all Australian states or territories due to jurisdictional regulations;
  • Must be used strictly in accordance with medical advice and product directions.

We make no guarantee that any particular product or service will be prescribed or made available to you. All clinical decisions are at the sole discretion of the treating practitioner.

Personal Use Only

Any products available for purchase through our Site are intended strictly for personal use. You must not resell, redistribute, or commercially exploit any products or services obtained through Velora HealthConnect. Prescription medications must only be used by the person for whom they were prescribed and must not be shared with or provided to any other person.

Any breach of this clause may result in immediate termination of your account and access to our services, and may be reported to the relevant regulatory authorities.

Health Disclaimer and Professional Advice

The content, services and materials provided on or through this Site are for general informational purposes only. They are not intended as a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

While Velora HealthConnect facilitates access to AHPRA-registered practitioners and healthcare professionals, the information provided on this Site (including blog posts, educational content and lifestyle guidance) does not constitute medical advice and should not be relied upon as such.

You acknowledge and agree that:

  • Any clinical advice, diagnosis or treatment is provided solely by the treating practitioner, not by Velora HealthConnect;
  • You are responsible for making your own informed decisions about your health, in consultation with your treating practitioner;
  • Velora HealthConnect does not guarantee the accuracy, completeness or currency of any health-related content on the Site;
  • In the event of a medical emergency, you should call 000 or attend your nearest emergency department immediately.

Nothing on this Site should be construed as an attempt to offer or practise medicine, nor does it create a practitioner-patient relationship between you and Velora HealthConnect.

No Guarantee of Results

Health outcomes vary between individuals and are influenced by a wide range of factors including genetics, lifestyle, adherence to treatment plans and pre-existing medical conditions. Velora HealthConnect does not guarantee any specific health outcome, result or benefit from the use of our services, products or programs.

You acknowledge and agree that:

  • Any testimonials, case studies or before-and-after results shared on our Site or social media are individual experiences and do not represent typical or guaranteed outcomes;
  • Results depend on your full and honest participation, including following clinical advice, adhering to prescribed treatments and making recommended lifestyle changes;
  • We are not liable for any dissatisfaction with results where you have not followed the treatment plan or clinical advice provided;
  • No representation made by any employee, contractor or affiliate of Velora HealthConnect constitutes a guarantee of results.

Personal Responsibility

By using our Site and services, you accept personal responsibility for your health decisions and outcomes. You agree to provide accurate and complete information during intake, consultations and at any time requested by your treating practitioner. You acknowledge that withholding or providing false or misleading information may affect the safety and effectiveness of your care, and that Velora HealthConnect and its practitioners will not be held liable for any adverse outcomes resulting from incomplete or inaccurate information provided by you.

Brand and Product References

Any reference to third-party brands, products, medications or services on this Site is for informational purposes only and does not constitute an endorsement, recommendation or guarantee by Velora HealthConnect unless expressly stated. All product names, trademarks and registered trademarks are the property of their respective owners. Velora HealthConnect is not affiliated with, sponsored by or endorsed by any third-party brand unless explicitly disclosed.

Feedback, Complaints and Disputes

Feedback and Complaints Process

We value your feedback and are committed to resolving any concerns promptly and fairly. If you have a complaint about our services, products or your experience with Velora HealthConnect, please follow these steps:

  2. Acknowledgement — We will acknowledge your complaint within 5 business days.
  3. Investigation — We will investigate the matter and aim to provide a resolution within 14 business days. If more time is required, we will keep you informed of the progress.
  4. Resolution — We will communicate the outcome and any proposed remedy to you in writing.

Public Reviews and Statements

We encourage honest and constructive feedback. However, you agree not to publish or share any statements about Velora HealthConnect, its practitioners or staff that are false, misleading, defamatory or intended to cause harm. We reserve the right to take appropriate action, including legal proceedings, in response to any statements that we consider to be defamatory or damaging to our reputation.

Mediation

If a complaint cannot be resolved through our internal complaints process, either party may refer the matter to mediation through an accredited mediator. Both parties agree to participate in mediation in good faith before commencing any legal proceedings. The costs of mediation will be shared equally between the parties unless otherwise agreed.

Intellectual Property

No Commercial Use

All content on this Site, including but not limited to text, graphics, logos, images, video, audio, software, code, layout and design ("Content"), is the intellectual property of Velora HealthConnect or its licensors and is protected by Australian and international copyright, trademark and intellectual property laws. Refunds for Online Digital Products

Due to the nature of digital products, all sales are generally considered final once access has been granted or the product has been delivered. Refunds may be considered in the following circumstances:

  • The product was not delivered or is materially different from what was described at the time of purchase;
  • A technical issue prevents you from accessing the product and we are unable to resolve it within a reasonable timeframe.

Refund requests must be submitted within 7 days of purchase by emailing [email protected]. Each request will be assessed on a case-by-case basis. Nothing in this clause limits your rights under Australian Consumer Law.

  • Warrant that your User Content is original, does not infringe the intellectual property rights of any third party, and does not contain any material that is defamatory, offensive, unlawful or in breach of any applicable law;
  • Acknowledge that we are not obligated to publish, display or retain any User Content;
  • Accept that we may edit, remove or refuse to publish any User Content at our sole discretion.

We reserve the right to remove User Content that we consider to be inappropriate, misleading, defamatory, in breach of these Terms, or otherwise harmful to our business or community. You are solely responsible for any User Content you submit.

Marketing

We may from time to time send you marketing communications about our products, services, promotions and events. All marketing communications will be sent in compliance with applicable laws, including the Spam Act 2003 (Cth) and the Australian Privacy Principles.

  • You will only receive marketing communications where you have provided your express or implied consent;
  • Every marketing communication will include a clear and functional opt-out or unsubscribe mechanism;
  • You may withdraw your consent to receive marketing communications at any time by using the unsubscribe link, contacting us at [email protected], or completing the contact form;
  • Opting out of marketing communications will not affect transactional or service-related communications (such as appointment reminders or order confirmations);
  • We may use third-party marketing platforms and analytics tools (including social media and email platforms) to manage and deliver marketing communications. These third parties are subject to their own privacy policies and terms.

Service Provider Registration Details

Velora HealthConnect is a trading name of Velora Edge Group Pty Ltd (ABN 24 693 639 879). Our healthcare practitioners are registered with the Australian Health Practitioner Regulation Agency (AHPRA) and practise in accordance with the relevant National Board standards and codes of conduct. You may verify a practitioner's registration status at www.ahpra.gov.au.

Prohibited Use

You agree not to use this Site, our services or any content provided through the Site for any purpose that is unlawful, harmful or otherwise prohibited by these Terms. Without limitation, you must not:

  • Use the Site in any way that could damage, disable, overburden or impair the Site or interfere with any other party's use of the Site;
  • Attempt to gain unauthorised access to any part of the Site, other accounts, computer systems or networks connected to the Site;
  • Use any automated means (including bots, scrapers or spiders) to access or collect data from the Site without our prior written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Upload, transmit or distribute any viruses, malware or other harmful code;
  • Use the Site to harass, abuse, threaten, defame or otherwise violate the rights of any person;
  • Reproduce, duplicate, copy, sell, resell or exploit any portion of the Site or its content for commercial purposes without our express written permission;
  • Use our services to obtain prescription medications for purposes other than personal therapeutic use;
  • Provide false, misleading or fraudulent information to obtain products, services or prescriptions;
  • Engage in any activity that violates any applicable local, state, national or international law or regulation.

We reserve the right to investigate and take appropriate action, including suspending or terminating your access to the Site and reporting any suspected unlawful activity to the relevant authorities.

Warranties and Disclaimers

This Site and all content, products and services provided through it are offered on an "as is" and "as available" basis. To the maximum extent permitted by law, Velora HealthConnect disclaims all warranties, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy.

We do not warrant that:

  • The Site will be available at all times, uninterrupted, secure or error-free;
  • The information, content or materials on the Site are accurate, complete, reliable or current;
  • Any defects or errors on the Site will be corrected;
  • The Site or its servers are free of viruses or other harmful components.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.

Limitation of Liability — Use of Site

To the maximum extent permitted by law, Velora HealthConnect, its directors, officers, employees, agents and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of, or inability to use, this Site, including but not limited to loss of data, loss of revenue, loss of business or any other intangible losses, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to your use of the Site shall not exceed the total amount paid by you to Velora HealthConnect in the 12 months preceding the event giving rise to the claim, or $100 AUD, whichever is greater.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Australian law.

Limitation of Liability — Products and Services

To the maximum extent permitted by law, Velora HealthConnect will not be liable for any loss, damage, claim or expense arising out of or in connection with:

  • The use or misuse of any product or service purchased through our Site;
  • Any adverse reaction, side effect or health outcome resulting from the use of products or services, where you have not followed the instructions, advice or treatment plan provided by your treating practitioner;
  • Any delay or failure in the delivery of products caused by third-party logistics providers;
  • Any reliance on information or content provided on the Site that is not specific clinical advice from your treating practitioner;
  • Actions or omissions of independent third-party healthcare providers, pharmacies or other service providers.

Where our liability cannot be excluded, it is limited to, at our option: re-supplying the service, or paying the cost of having the service supplied again. This clause does not exclude or limit any rights or remedies available to you under the Australian Consumer Law.

Our Right to Be Indemnified by You

You agree to indemnify and hold harmless Velora HealthConnect, its directors, officers, employees, agents and affiliates from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Site or our services;
  • Your breach of these Terms;
  • Your violation of any applicable law, regulation or third-party rights;
  • Any content you submit to the Site or our social media channels;
  • Any inaccurate, false or misleading information you provide to us or our practitioners;
  • Any claim by a third party arising from your actions or omissions in connection with our services.

This indemnity survives the termination of these Terms and your use of the Site.

Additional Terms

Certain services, products or promotions offered through our Site may be subject to additional terms and conditions ("Additional Terms"). Where Additional Terms apply, they will be made available to you at the time of purchase or registration and will form part of your agreement with us. In the event of any conflict between these Terms and any Additional Terms, the Additional Terms will prevail to the extent of the inconsistency.

Competitions and Promotions

From time to time, we may run competitions, giveaways or promotional offers through our Site or social media channels. Breach and Termination

  • Cancelling any pending orders or subscriptions;
  • Taking legal proceedings against you for reimbursement of all costs (including but not limited to reasonable legal fees) resulting from the breach;

We may terminate or suspend your access to the Site and our services at any time and for any reason, including if we reasonably believe you have violated these Terms or any applicable law. Upon termination, all rights and licences granted to you under these Terms will immediately cease.

Severability

The remaining provisions will continue in full force and effect. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them for the purpose of any proceedings arising out of or in connection with these Terms. If any dispute arises in relation to these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiation and, if necessary, mediation before commencing legal proceedings.
